Terms and Conditions

1. Introduction

Welcome to Triangle J Water Wells.

These Terms and Conditions (“Terms”) govern the services provided by us, including water well drilling, water well service, well plugging, and storage tank installation in Texas. By using our services, you agree to comply with and be bound by these Terms.

 

2. Services Provided

Our services include but are not limited to: Water well drilling and installation, well plugging and abandonment (in accordance with Texas Commission on Environmental Quality (TCEQ) and Texas Department of Licensing and Regulation (TDLR) regulations) Water storage tank installation Well maintenance and repair. Other related services as agreed upon in writing. All services are subject to site evaluations, permitting, and compliance with Texas state water laws.

3. Permits and Compliance

In Texas, well drilling and plugging must comply with TDLR and local groundwater conservation district (GCD) regulations. Clients are responsible for obtaining all necessary permits unless otherwise agreed in writing. We are not liable for any regulatory violations resulting from client failure to secure proper permits.

 

4. Estimates, Payments, and Deposits

Estimates are based on surrounding site assessments and may change due to unforeseen geological conditions. A deposit will be required before work begins, with the balance due upon completion. Late payments may be subject to interest charges of 3% per month and potential collection fees. In case of additional work due to unexpected site conditions, costs will be discussed and agreed upon before proceeding.

 

5. Client Responsibilities

Provide clear access to the worksite. Disclose any known underground utilities, hazards, or past well issues. Ensure compliance with local groundwater conservation district regulations. Maintain the well according to Texas well maintenance guidelines.

6. Warranties and Liability

We guarantee that our services will be performed in compliance with Texas state laws and industry standards. We do not guarantee water quantity, quality, or potability. We are not responsible for natural conditions affecting water availability or quality. Our liability is limited to the cost of the services provided, and we are not liable for indirect or consequential damages.

7. Well Plugging and Abandonment

We follow Texas well-plugging regulations outlined by TDLR and TCEQ. A plugging report will be filed with the appropriate authorities upon completion. Clients must disclose any known contaminants or hazardous materials in the well before plugging.

8. Cancellations and Refunds

Cancellation fees may apply if work is canceled after scheduling. Deposits may be refundable or non-refundable depending on project status and costs incurred.

9. Dispute Resolution

Any disputes will first be attempted to be resolved through mediation. If unresolved, disputes will be subject to arbitration in accordance with Texas laws.

10. Amendments

We reserve the right to update these Terms at any time. Continued use of our services after updates constitutes agreement to the revised Terms.
